OBIBA / TRUST

Terms of Service

The general terms for using Obiba. Read these alongside the terms and disclosures for the particular services available to your account.

1. Scope of these terms

These terms apply to your use of Obiba’s website, app and related services. Read them together with the Privacy Policy and any terms, fees or risk disclosures presented for a specific service. A regulated financial product may be supplied under a separate agreement identifying its provider. These terms do not represent that Obiba holds a banking, payment, investment or other regulatory licence.

2. Eligibility and account information

You must have legal capacity to enter the relevant agreement and meet the age, location and verification requirements shown during registration. Provide accurate information and keep it current. A person acting for a business must be authorised to do so. You must not impersonate another person or use an account to bypass eligibility restrictions.

3. Available services

Only features enabled for your account and country are available for use. Availability may depend on verification, service providers, regulatory requirements and transaction limits. Website illustrations, example balances and descriptions of planned features are not live quotes or promises of availability. An app-store download does not by itself establish eligibility for a financial service.

4. Account security and authority

Keep your device and sign-in credentials secure. Do not share passwords, PINs, one-time codes or private keys. Contact hello@obibajk.com promptly if you suspect unauthorised access, a lost device or an incorrect payment. Responsibility for a disputed transaction will be assessed under the applicable law and service agreement; these terms do not automatically make you liable for every transaction made using your credentials.

5. Payment instructions

Check the recipient, destination, amount, currency, network and any fee before authorising a payment. An instruction may be subject to verification, balance, limits and compliance checks. A submitted or pending transaction is not necessarily settled. Do not repeatedly submit a payment solely because a response is delayed; check its status or contact support.

6. Fees and currency conversion

Review the applicable fees, exchange rate, total debit, recipient amount and quote expiry before confirming a transaction. Third-party or network charges may apply where disclosed. An expired quote may require a new confirmation. Illustrative exchange rates on the website are not binding rates. Any material change to an accepted instruction must be handled in accordance with the relevant agreement and law.

7. Digital assets and network risk

Where a service involves stablecoins or other digital assets, risks can include loss of a currency peg, issuer or custodian failure, network congestion, smart-contract faults, incorrect destination addresses and irreversible transfers. A digital asset should not be assumed to be legal tender, a bank deposit, insured or guaranteed. Review the product’s custody, redemption and risk disclosures before use. Nothing on this website is personal investment advice or a promise of returns.

8. Delays, errors and refunds

Processing times depend on the relevant network, bank, mobile-money operator, recipient and compliance checks. Some completed transfers cannot be cancelled. Report an error or disputed payment promptly with its reference, date and a description of the issue. Obiba or the identified provider will need to investigate the records and applicable rules before determining correction, recovery or refund rights. Mandatory consumer rights remain unaffected.

9. Acceptable use

Do not use the services for fraud, impersonation, money laundering, unlawful financing, sanctions evasion or other unlawful activity. Do not interfere with systems, exploit vulnerabilities, circumvent limits, submit malicious content or obtain unauthorised access to another person’s data. Transactions may require additional information where reasonably necessary to meet legal or security requirements.

10. Third-party services

Banks, payment networks, mobile-money operators, digital-asset providers and other third parties may apply separate terms. Their involvement and relevant conditions must be disclosed for the service concerned. Links to external sites do not amount to an endorsement or guarantee. These terms do not exclude responsibilities that applicable law places on Obiba for its own services.

11. Agent and business instructions

If an agent or delegated payment feature is enabled, the account owner must authorise its scope, budget and permissions. Delegation does not remove transaction checks or legal requirements. Review permissions regularly and pause or revoke them when no longer needed. A business administrator must have authority to act for the business and should restrict access according to each user’s responsibilities.

12. Restrictions and suspension

Access or a transaction may be restricted where reasonably necessary for security, suspected misuse, legal obligations or breach of the applicable agreement. Reasons and next steps should be communicated where legally permitted. A restriction does not automatically extinguish your rights to funds, records or a complaint. Contact support to ask about review and any steps needed to restore access.

13. Closing your account

You may request account closure and deletion by emailing hello@obibajk.com. Before closure, any remaining balance, pending transactions, disputes or lawful obligations must be resolved through an appropriate process. Closure does not erase records that must legally be retained, or cancel existing obligations. The Privacy Policy explains deletion requests and retained information.

14. Intellectual property and app distribution

Obiba’s branding, software and original content are protected by applicable intellectual-property laws. You may use the app for its intended lawful purpose, subject to these terms and any applicable app licence. You may not misrepresent ownership, remove proprietary notices or copy protected material except as permitted by law. Apple and Google operate their own distribution platforms; downloading the app does not make either company the provider of Obiba’s financial services.

15. Service limitations and liability

Online services can be affected by maintenance, outages and events outside reasonable control. No statement here guarantees uninterrupted access or eliminates financial risk. Responsibility for loss depends on the applicable law, the relevant service agreement and the circumstances. Nothing in these terms excludes liability or rights that cannot lawfully be excluded, including applicable obligations relating to fraud, personal data or consumer protection.

16. Complaints and dispute resolution

Email hello@obibajk.com with the subject “Obiba complaint”, a description of the issue and relevant transaction references. Do not send secrets or complete card details. Request a written response and keep the correspondence. If the matter concerns a regulated service, the relevant provider’s complaints process and competent regulator may also apply. You retain the right to seek available regulatory or judicial remedies.

17. Governing law and changes

These general terms are intended to be governed by the laws of Ghana, subject to mandatory protections applicable to you and any separate product agreement. A dispute may be referred to a court with lawful jurisdiction. Updated terms will be published with an updated date; material changes require appropriate notice and any consent required by law. Questions about these terms may be sent to hello@obibajk.com.
